A successful outcome depends on the circumstances of the dispute and the willingness and ability of the participants to engage constructively in the process.

No particular settlement or outcome is promised.

6. Conflict Coaching

Conflict coaching is a supportive service designed to help an individual understand and manage a conflict more effectively.

Conflict coaching does not constitute legal representation or legal advice.

The coach does not make decisions on behalf of the client and cannot guarantee a particular outcome.

Where appropriate, we may recommend that you obtain independent legal, financial, medical or other professional advice.

7. International and Online Services

Where mediation is provided online or involves participants in different countries, additional practical or legal considerations may apply.

Participants are responsible for ensuring that they have access to suitable technology and a reasonably private environment for online sessions.

ALS Mediations will take reasonable steps to facilitate an effective online mediation but cannot guarantee uninterrupted internet or telecommunications services.

For international matters, participants may be subject to laws, regulations and professional requirements in different jurisdictions.

Where appropriate, participants should obtain independent legal advice concerning the laws applicable to their circumstances.

8. Enquiries and Initial Contact

Submitting an enquiry through our website does not automatically create a contract for mediation or any other service.

We may contact you to discuss your circumstances and determine whether our services may be appropriate.

A mediation or other service will only be arranged once the relevant terms, fees, availability and other necessary arrangements have been agreed.

9. Fees and Payment

Invoices must be paid according to the payment terms stated on the relevant invoice or agreement.

18. No Guarantee of Settlement

Mediation is a collaborative process, and no mediator can guarantee that the participants will reach an agreement.

ALS Mediations does not guarantee:

  • That a dispute will settle
  • That a participant will accept a particular proposal
  • That legal proceedings will be avoided
  • That a particular financial or commercial outcome will be achieved
  • That a relationship will be restored

Our role is to facilitate a fair and constructive process in which participants can explore the possibility of resolution.

19. Limitation of Liability

Nothing in these Terms & Conditions excludes or limits liability where doing so would be unlawful.

In particular, nothing in these Terms & Conditions excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot legally be excluded or limited.

Subject to applicable law, ALS Mediations will not be responsible for losses that are not reasonably foreseeable or that arise from matters outside our reasonable control. 

Where you are a consumer, nothing in these Terms & Conditions affects your statutory rights.

Any limitation or exclusion of liability will be interpreted subject to applicable law and the circumstances of the relevant service.

We will not be responsible for delay or failure to perform an obligation where this is caused by circumstances beyond our reasonable control.
